My first thought exactly. Fault is still on the driver who rear ended OP, but I cannot imagine why anyone would tint their taillights and make their car less visible. Sure, the lights may still be visible, but in OP’s picture the turn signal light is clearly dimmer than if the taillights weren’t tinted.
